These Terms of Use (“Terms”) govern your use of ripheadz.com (the “Site”), owned and operated by Ripheadz LLC (“Ripheadz,” “we,” “us”), based in Lebanon, Indiana. By using the Site, submitting content, or leaving a comment or rating, you agree to these Terms, our Privacy Policy, and our Disclaimer. If you do not agree, please do not use the Site.

1. Who may use the Site

The Site is intended for a general audience. You must be at least 13 years old to use the Site, and at least 18 years old (or have a parent or guardian’s permission) to submit listings, comments, or ratings.

2. Our content

The Site’s original content — including its text, layout, design, checklist formatting, and the Ripheadz name and logo — belongs to Ripheadz LLC. You may view and share links to the Site for personal, non-commercial use. You may not copy, scrape, republish, or sell the Site’s content or data in bulk, or use it to build a competing database or service, without our written permission.

Product names, logos, images, and trademarks of card manufacturers, leagues, teams, and others belong to their respective owners and are used for identification and informational purposes only, as described in our Disclaimer.

3. Content you submit

The Site lets you submit card shows and events, breaker channels, comments, ratings, images, and other information (“Submissions”).

Your promises. When you make a Submission, you confirm that:

  • the information is accurate to the best of your knowledge;
  • you own it or have the right to share it, including any flyers, logos, or images;
  • it does not infringe anyone’s copyright, trademark, privacy, or other rights; and
  • it follows the rules in Section 4.

Permission you give us. You keep ownership of your Submissions. By submitting, you give Ripheadz a free, non-exclusive, worldwide, perpetual license to publish, display, edit (for length, clarity, formatting, or accuracy), and share your Submission on the Site and on Ripheadz social media and promotional channels, in connection with operating and promoting Ripheadz.

Our discretion. We are not required to publish any Submission. We may review, edit, decline, or remove any Submission at any time, for any reason, without notice. We do not verify every Submission and are not responsible for content submitted by others.

4. Community rules for comments and ratings

Comments and ratings help collectors find shows and breakers they can trust, so we ask that they be honest and fair. You agree not to post anything that:

  • is false, misleading, or a fake review — including reviews of your own channel, event, or business, reviews written for pay or other reward, or reviews of a competitor meant to harm them;
  • is not based on your own firsthand experience;
  • is defamatory, harassing, threatening, hateful, obscene, or abusive;
  • shares someone else’s private or personal information;
  • is spam, advertising, or unrelated self-promotion;
  • infringes anyone’s intellectual property or other rights; or
  • is illegal or encourages illegal activity.

If you have a business or personal relationship with a breaker, show, or shop you are reviewing, say so in your comment. We may remove content that breaks these rules and may block users who repeatedly break them.

5. Opinions and the Ripheadz Score

Comments and ratings reflect the opinions of the individual users who post them, not Ripheadz. Where a listing shows a Ripheadz Score or other Ripheadz rating, that score is our own opinion, based on our experience and the information available to us, and is not a statement of fact or a guarantee about any breaker, event, or business.

6. Third-party listings, breakers, and transactions

Card shows, events, breakers, shops, sellers, and other third parties listed on the Site are independent. Ripheadz does not organize, operate, endorse, or guarantee them, and we are not a party to any purchase, break, trade, or other transaction between you and them. Any dispute about a transaction is solely between you and that third party. Always use your own judgment before attending an event, joining a break, or sending money.

7. Copyright complaints and repeat infringers

We respect intellectual property rights and respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512). To submit a notice, follow the instructions and contact our designated Copyright Agent as described in our Disclaimer.

If you believe content you submitted was removed by mistake, you may send a counter-notice to our Copyright Agent with: your physical or electronic signature; identification of the removed content and where it appeared; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; and your name, address, phone number, and consent to the jurisdiction of the federal court for your district (or, if outside the United States, any district where Ripheadz may be found).

Repeat infringer policy. It is our policy, in appropriate circumstances, to remove the content of, block, and stop accepting Submissions from users who repeatedly infringe the copyrights or other intellectual property rights of others.

8. Prohibited uses

You agree not to:

  • use the Site for any unlawful purpose;
  • scrape, crawl, or harvest the Site’s content or data by automated means, except standard search engine indexing;
  • interfere with, disrupt, or try to gain unauthorized access to the Site or its systems;
  • impersonate any person or business, or misrepresent your affiliation with anyone; or
  • upload viruses or other harmful code.

9. Advertising and links

The Site displays advertising and may contain affiliate links, as described in our Disclaimer and Privacy Policy. The Site also links to third-party websites. We are not responsible for advertisers, affiliate partners, or linked websites, or for any products, services, or content they provide.

10. Disclaimers

The Site and all content are provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, completeness, availability, merchantability, fitness for a particular purpose, or non-infringement. Release dates, checklists, odds, print runs, box configurations, prices, and listings may be incomplete, outdated, or changed by others without notice. See our Disclaimer for more.

11. Limitation of liability

To the fullest extent permitted by law, Ripheadz LLC and its owners, members, and contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost money, lost profits, lost value, or missed releases, arising from your use of the Site, your reliance on its content, any Submission, or any event, break, purchase, or transaction with a third party. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).

12. Indemnification

You agree to defend, indemnify, and hold harmless Ripheadz LLC and its owners and members from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your Submissions, your violation of these Terms, or your violation of anyone else’s rights.

13. Suspension and termination

We may suspend or end your ability to use the Site or make Submissions at any time, for any reason, including violation of these Terms. Sections 3 (permission you give us), 5, 6, and 10–15 continue to apply afterward.

14. Governing law and disputes

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law rules. Any dispute relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Boone County, Indiana, or the Southern District of Indiana, and you consent to their jurisdiction. Either party may bring a qualifying claim in small claims court instead.

15. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms, together with our Privacy Policy and Disclaimer, are the entire agreement between you and Ripheadz about the Site. We may update these Terms at any time; changes take effect when posted on this page with a new “Last updated” date, and your continued use of the Site means you accept them.
